Proposed Protective Change to 2nd Amend to Protect the Individual Right.

This writer has a good idea. The individual right interpretation hangs by one vote in the Supreme Court. If Obama is re-elected and gets to replace on the the 5 justices in the majority in Heller and McDonald, the individaul right could disappear.

  1. With all due respect to SCOTUS, I don't care what anti-gun decision they may potentially come up with. The individual right to keep and bear arms is not granted but recognized by the Bill of Rights. It's an inalienable right, not lawful. It can't be denied. Government only has the power to harass people choosing to exercise this individual right.

  2. 44: Yes, good point.The right to have weapons for defense is a natural law right. However, natural law rights are not enforceable in court unless they are codified (made a part of man-made law). Although one could argue that the Ninth Amendment is a vehicle for enforcing natural law rights, a majority of the Supreme Court has never so held.
