Victory for First Amendment

As I predicted earlier in this blog, the wackos won. Don't think of it as a defendant's victory in the obnoxious, offensive,funeral protest case as a victory for those wackos. Think of it as a victory for First Amendment values and the rule of law. Sometimes application of legal principles can result in a decision that rubs us the wrong way. The rule of law requires that even the wackos get First Amendment protection.

  1. I agree with SCOTUS' decision as this church group is no different than the KKK and Neo-NAZIs. The latter groups regularly spread their hateful message with their purpose known to be shockingly offensive to bystanders. As with this hate filled congregation, said malicious groups exploit the first amendment to spread their self-righteous evil intolerance. The devil never had it so good.

  2. 44 Thanks: To paraphrase someone else: "Freedom is never free." Viz., there are always costs to be paid/suffered in a free society when people take advantage of rights to "harm" others. It's the price we pay for living in the freest country on the face of the earth. However, our freedoms are always under attack, from both the left and right and government officials. They will attempt to exaggerate and exploit these costs by taking advantage of various propaganda techniques. I believe it was Jefferson who said "Eternal vigilance is the price of liberty"
