Latest on D.C. gun laws

Although the changes in D.C. law are significant, they still reflect an opposition to home ownership of handguns for defensive purposes which is protected by the Second Amendment. Both D.C. and Chicago continue to bob and weave and alter their laws to stay one step ahead of litigation. How foolish of us to think that the Bill of Rights is part of the supreme law of the land, that public officials honor their oaths to support and defend the constitution, and that they recognize the long-established authority of the Supreme Court to strike down state and federal laws.

2nd Amendment Takes Another Hit

Anyone who thinks that the federal courts are generally enthusiastic about protecting people's rights, needs to look at recent Second Amendment caselaw. The most recent travesty is reported here. This is not rocket science. The Second Amendment specifically mentions a right to "bear" arms. A total ban cannot possibly be constitutional. The author of the article is a UCLA law professor.

More delay and shenanigans in Second Amendment case

The Nordyke case from Calif. was expected to be a potential Second Amendment case for the Supreme Court. The generally anti-gun Ninth Circuit has pulled an unusual move by ordering the case to mediation, even though an opinion in the case was in the process of being written.

Gun Sales Explode as Election Looms

Great time to own stock in gun and ammo companies! It seems many folks remember Obama's 2008 "Bittergate" speech where he said lots of bitter people cling to their guns and religion. Many also seem to realize that their Second Amendment rights hang by a single vote in the U.S. Supreme Court.If an Obama appointee replaced one of the Heller/McDonald 5, the Second Amendment rights of individuals not connected to a militia will disappear. This is thus a landmark election for many reasons.

Significant Second Amendment victory

For the first time, as far as I can tell, a federal court has specifically invalidated a state law on the basis that the Second Amendment word "bear" means possession outside the home. It's amazing how long it has taken for common sense and respect for the Constitution to take hold. See the District Judge's opinion striking down a portion of Maryland law requiring that applicants for a concealed carry permit show a "good and substantial reason" to qualify for the permit. My congratulations to Judge Legg for having the courage to stand up for the Bill of Rights.

Few National Constitutions have a Provision on Gun Rights

ONLY 2 OTHER NATIONS HAVE A CONSTITUTIONAL RIGHT SIMILAR TO THE U.S. SECOND AMENDMENT.
Other than the U.S., only two other national constitutions have something similar to the American Second Amendment. Interestingly, these two are Mexico and Guatemala. However, both of these provisions are narrower than the American provision. Over the years, a number of nations repealed their version of the right. It appears that individual gun rights are increasing being sacrificed to government power. It is disturbing to see how few governments trust their own people. See pp. 13 & 38 in the linked document. Proposed Protective Change to 2nd Amend to Protect the Individual Right.

This writer has a good idea. The individual right interpretation hangs by one vote in the Supreme Court. If Obama is re-elected and gets to replace on the the 5 justices in the majority in Heller and McDonald, the individaul right could disappear.
