However, I think the better argument is that it is constitutional under sec. 5 of the 14th Amend.
I agree, the main reason for the Bill of Rights was the fear of the federal government and that the powers granted by the new Constitution would be stretched and abused at the cost of individual liberties and the prerogatives of the states.Anonymoushttps://www.blogger.com/profile/09908922017589211092noreply@blogger.comtag:blogger.com,1999:blog-7060696059642580878.post-10668893632050691672012-08-28T09:21:36.953-05:002012-08-28T09:21:36.953-05:00Welcome back Professor Kessler. The abstract investigated if "... the National Right to Carry Reciprocity Act of 2011 is a proper exercise of Congress’ Commerce Clause power and whether the Act is constitutional.". What???

The Bill of Rights alone easily answered that concern where it states "... the right to keep and [BEAR] Arms ...". I suppose the founders' amended constitutional clarification was not clear enough to today's over inflated social progressive egos. The commerce clause was one of the main reason why these first ten amendments were added. 44https://www.blogger.com/profile/12279323738793315123noreply@blogger.com
