Legal Standards for Use of Force against Immigration Detainees
Great article on an important topic. Due process is the standard. AELE is a great organization for finding good, current, legal materials relevant to CJ. If these topics interest you, I strongly you subscribe to their updates. LINK
Regardless of a detainee's origin, the use of force becomes necessary when encountering destructive and/or dangerous behavior. The time to back-off is when the threat has ended. Unlike the general public, peace officers assume the added burden of routinely dealing with bad actors.
A great deal of light goes on with the playing of videotape and soundtrack of the episodes at the orgin of these cases. I'm often amazed at the endless eloquence that can arise over individuals who simply "need killin'. Even in the middle of a monstrous tantrum, fear of death is primal . . . fear of losing a rational argument isn't even on the first page.
